TMN is a platform for social learning and networking, as well as for the exchange of ideas and resources among global learning professionals and thought leaders.  Our website is available to all visitors, although some content and features are restricted to TMN members.  

 

Website Terms of Use 

Please read carefully the following Terms and Conditions, as they govern your (identified herein as “Authorized User”) access to and use of the TMN website and any products, services, materials, or information available through the TMN website or used in connection therewith (collectively, the “Service”) provided by TMN (identified herein as “We” or “TMN”).  TMN is willing to license the use of this TMN website to you, only on the condition that you accept and agree to all the Terms and Conditions stated below.  If you do not agree, you will not be granted permission to access or use the TMN website and are instructed to exit immediately. By using or accessing the "Service", or any component thereof, in any manner whatsoever, you agree to be bound by and comply with the terms and conditions of this Agreement. Should you have any objections to this Agreement, do not access or use the Service in any manner.  TMN reserves the right to change the terms and conditions of this Agreement periodically. It is the Authorized User’s responsibility to review them when conducting business herein.

 

Personal Information 

To gain membership, access to members-only resources, and personalization features on www.trainingmagnetwork.com, the Authorized User is required to register and provide valid contact information and general information about the Authorized User and Authorized User’s organization. Similar information may be submitted to TMN through membership applications, conference or seminar registrations, publication orders, subscriptions, and contest registrations. TMN will maintain this information in our customer database. We may also collect additional information, such as in connection with events, special offers, contests, or other promotions. If you provide us with any personal information, you should inform us immediately of any changes to the information that you provided by updating your personal details by sending an email to support@trainingmagnetwork.com. In some cases, when you connect to our website we may automatically (i.e., not via registration) collect technical information that is not personally identifiable. Examples of this type of information include the type of Internet browser you are using, the type of computer operation system you are using, and the domain name of the website from which you linked to our site.

 

TMN Use of Your Email Address

TMN uses your email address for the following purposes: 

  1. As a means of correspondence with members and customers on TMN matters that may include, but are not limited to, membership status, confirming and updating contact information, billing, registration for webinars/events, and order confirmations.
  2. As a means to distribute information to members and customers that may include, but is not limited to, membership and customer news and other products and services from TMN and its partner Training magazine.

 

Personal Information to Other Parties

TMN does not sell or make its membership list available to third-party organizations.  However, members who sign up to attend a sponsored webinar may be contacted by the sponsors after the webinar.  You may opt out of receiving the sponsors' messages at any time.  TMN paying members who receive a Training magazine digital edition as part of their membership benefit will be added to the Training subscriber database and become a customer of TMN’s partner Training magazine adhering to their privacy policies.  TMN paying members may opt out of the Training magazine subscription at any time. TMN may be required by law enforcement or judicial authorities to provide information on individual Users to the appropriate governmental authorities.  In matters involving a danger to personal or public safety, TMN may voluntarily provide information to appropriate governmental authorities.

 

Non-transferability of Membership

Membership is non-refundable and non-transferable.

 

Personal Information Security

TMN Online has security measures, such as firewalls, in place to protect against loss, misuse, and alteration of your User data under our control. While we cannot guarantee that loss, and misuse or alteration to data will not occur, we take reasonable precautions to prevent such unfortunate occurrences. Any other particularly sensitive information, such as your credit card number, collected for a commerce transaction, is encrypted prior to transmission. You are ultimately responsible for the security of your TMN member ID and password. You may not share your TMN member ID and password with colleagues or friends so they can access content or features on TMN Online that are restricted to TMN members only. You should log out of your browser at the end of each computer session to ensure that others cannot access your personal information and correspondence, especially if you share a computer with someone else or are using a computer in a public place like a library or Internet cafe.

 

Cookies

Cookies are files that contain information created by a web server that can be stored on a User's hard disk for use either during a particular session ("per-session" cookie) or for future use ("persistent" cookie). TMN uses cookies only to facilitate automated activity, store and track passwords, determine appropriate solicitations, and review navigation patterns. Cookies are not used to disseminate significant information about Users over the Internet or to analyze any information that Users have knowingly or unknowingly provided. Authorized Users may instruct their Internet browsers to opt out of accepting a "persistent" cookie and rather accept only a "per-session" cookie, but they will need to login each time they visit the site to enjoy the full benefits. If the Authorized User declines the attachment of any cookie, the Authorized User may not have access to the full benefits of the website. Registration enables the site to better determine members' interest areas and provide the most relevant information.

 

Termination of Membership

Basic Memberships are for an indefinite period of time and are effective until terminated by the Member or TMN.  Paid memberships are effective for one year.  At the end of the one-year term, the membership is renewed, canceled, or downgraded to the Basic Level.

 

Termination by TMN

TMN may immediately terminate your account, with subsequent notification, if TMN reasonably believes that your account is being used to engage in activity that violates applicable law or any provision of these Terms. In such event, you will not be entitled to any refund of prepaid fees for membership subscriptions and/or services that have not yet been provided.

 

Termination by You

You may terminate your membership at any time by logging into your account and choosing the cancellation option or by calling customer support.  If you terminate your account, you will remain obligated to pay all outstanding fees and charges, if any, relating to your use of the product or service incurred before termination.

 

Visitor and User Conduct

TMN wishes to provide opportunities to exchange information and ideas that help individuals, companies, and the community at large build expertise within the field of talent management. 

Therefore, you must agree not to:

  1. Post or disseminate any User Content that is unlawful, harassing, defamatory, abusive, threatening, obscene (e.g. nudity, pornographic or sexually explicit images), harmful, tortious, libelous, or invasive of another's privacy;
  2. Post or disseminate any User Content that infringes or violates any party's copyright, trademark, trade secret, patent, or other proprietary right, including, but not limited to, using or distributing third party copyrighted materials without appropriate permission or attribution; trademarks without appropriate permission or attribution; information (whether or not protected as a trade secret) in violation of a duty of confidentiality; or other intellectual property or proprietary infringement;
  3. Post or disseminate any worms, viruses, or other harmful, disruptive, or destructive files, codes, or programs;
  4. Post or disseminate any advertising, explicit commercial solicitations, promotional materials, chain letters, pyramid schemes, spam, junk mail, or any other type of unsolicited mass email to people or entities that have not agreed to be part of such mailings;
  5. Impersonate any person or entity, including but not limited to, selecting or using a User name or email address of another person; falsely stating or otherwise misrepresenting your affiliation with any person or entity; intentionally omitting, deleting, forging, or misrepresenting transmission information, including headers, return mailing, and Internet protocol addresses; or otherwise manipulating identifiers to disguise the origin of any User Content transmitted;
  6. Post or disseminate any User Content you do not have the right to post, disseminate, or transmit;
  7. Disrupt the normal flow of dialogue or otherwise act in a manner that negatively affects other Users' ability to engage in real-time exchanges;
  8. Interfere with, disrupt, or harm in any way the Site or servers or networks connected to the Site;
  9. Attack the character or damage the reputation of other Users, name call, insult, ridicule, mock, electronically stalk or otherwise harass another user;
  10. Insult, attack, belittle, or ridicule the beliefs and life choices of other Users;
  11. Collect or store personal data about other users;
  12. Engage in any activities that would violate the personal privacy rights of others, including but not limited to, collecting and distributing information about other Users without their permission, except as permitted by applicable law;
  13. Use the Site for any illegal purpose;
  14. Post the first and last names or any other identifying information of any individual, including without limitation, where they work or the exact address where they live, unless you have their permission; notwithstanding this guideline, if you are posting factual information about a company, you may include the full name(s) of individuals and their job titles and locations, on condition that your post is accurate and not defamatory;
  15. Forward or post private messages that someone has sent you unless you have his/her written permission; or
  16. Select a screen name that is vulgar or obscene or that misrepresents you to other users

The TMN services may contain links to third-party websites or resources. You acknowledge and agree that we are not responsible or liable for: (i) availability or accuracy of such websites or resources or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by TMN of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risks arising from your use of any such websites or resources.

 

Third-Party Content

The TMN website may contain links to third-party websites that are not owned or controlled by TMN. Therefore, TMN has no control over, and assumes no responsibility for: the content, including, but not limited to, any opinions, advice, statements, services, and offers of third-party websites; and/or privacy policies or practices of any third-party websites. In addition, TMN will not and cannot censor or edit the content of any third-party site. By clicking on links, you expressly relieve TMN from any and all liability arising from your use of any third-party site or from the content of any third-party site. Accordingly, we encourage you to be aware when you leave the website and to read the terms and conditions and privacy policy of each website that you visit.  

 

Event Code of Conduct

In order to provide all participants with the opportunity to benefit from TMN events and activities, TMN is committed to providing a friendly, safe, supportive, and harassment-free environment for all event attendees and participants, regardless of gender, age, sexual orientation, gender identity, gender expression, disability, physical appearance, body size, race, ethnicity, religion, or other group identity. This code of conduct outlines TMN’s expectations for all event attendees and participants, including all members, speakers, vendors, media representatives, commentators, exhibitors, sponsors, and volunteers. Cooperation is expected from everyone. Organizers will actively enforce this code throughout this event. Violations are taken seriously.

 

Expected Behavior

TMN expects conference participants to communicate professionally and constructively, whether in person or virtually; handling dissent or disagreement with courtesy, dignity and an open mind; being respectful when providing feedback; and being open to alternate points of view. Likewise, when sharing information about the organization or any attendees or participants via public communication channels, TMN expects participants to share responsibly and clearly distinguish individual opinion from fact.

 

Unacceptable Behavior

TMN does not tolerate harassment of event attendees or participants in any form. Harassment includes offensive verbal or written comments and negative behavior, either in real or virtual space, including those which are related to or are based upon gender, age, sexual orientation, gender identity, gender expression, disability, physical appearance, body size, race, ethnicity, religion, or other group identity. Harassment also includes display of sexual images in public spaces, deliberate intimidation, stalking, following, harassing photography or recording, sustained disruption of talks or other events, and unwelcome physical contact or sexual attention. Sexual language and imagery are not appropriate for any event venues, including talks, workshops, social events, and social media. Sponsors, exhibitors, speakers, media representatives, commentators, and activity organizers may not use sexualized language, images, activities, or other material, or otherwise create a sexualized environment.

 

Consequences of Unacceptable Behavior

If an attendee or participant, in either real or virtual space, engages in inappropriate, harassing, abusive, or destructive behavior or language, the event organizers will determine and carry out the appropriate course of action, including warning the offender, expulsion from the event with no refund, and/or banning the offender from future TMN events and activities. All participants are expected to observe these rules and behaviors in all event venues, including online venues and conference social events. Conference participants seek to learn, network, and enjoy themselves in the process, free from any type of harassment. Please participate responsibly and with respect for the rights of others. If you are being harassed or notice that another person is being harassed, please bring this to the attention of the event staff.

 

Disclaimer of Warranty, Limitation of Liability

The site and services are provided to you on an “AS IS” and “AS AVAILABLE” basis and your use thereof is entirely at your own risk, except as specifically set forth in this Agreement.  We make no representations or warranties of any kind regarding the site and services, any products made available to you in connection therewith or your access to or use of any of the foregoing, whether express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, title, and/or non-infringement, or any warranties arising by course of dealing or custom of trade.  We make no representation or warranty that any material, content, products, or services displayed on or offered through the site and/or our services are accurate, complete, appropriate, reliable, or timely.  We also make no representation or warranties that the services will meet your requirements and/or your access to and use of the site and services will be uninterrupted or error-free; free of viruses, malicious code, or other harmful components; or otherwise secure.  Some jurisdictions do not allow the exclusion of certain warranties.  Accordingly, some of the above exclusions may not apply to you.

 

Limitation of Liability and Release

To the maximum extent permitted by applicable law, neither TMN, its licensors, suppliers, partners, affiliates, or third-party service providers shall be liable to you or any third party for any direct, indirect, incidental, special, exemplary, punitive, or consequential damages, or any other form of damages in any manner arising out of or in connection with this Agreement or your use of the site and services, regardless of the form of action or the basis of the claim or whether or not TMN has been advised of the possibility of such damages.  Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages.  Accordingly, some of the above limitation and exclusion may not apply to you. In the event you have any dispute with one or more third parties as a result of your use of the material or the services or are in any way damaged as a result of any third party in connection therewith, you hereby release and covenant not to sue or otherwise make a claim, demand, or file any legal action or institute any legal or regulatory processing against us, our affiliates, officers, directors, employees, agents, representatives, and suppliers from, for any claims, actions, demands, or damages (whether direct, indirect, special, incidental, or consequential) of whatever kind or nature, known or unknown, suspected or unsuspected, whether foreseeable or not, disclosed or undisclosed.

 

Indemnification

You agree to defend, indemnify, and hold us harmless against any losses, expenses, costs, or damages (including our reasonable attorneys' fees, expert fees, and other reasonable costs of litigation) arising from, incurred as a result of, or in any manner related to any claim or action based upon (a) your breach of the terms and conditions of this Agreement, (b) your use of the Services, and/or (c) the use of the Services by any other person using your IDs. We may, if necessary, participate in the defense of any such claim or action and any negotiations for its settlement or compromise. No settlement which may adversely affect our rights or obligations shall be made without our prior written approval. We reserve the right, at our own expense and on notice to you, to assume exclusive defense and control of any such claim or action and then your corresponding indemnification obligation will end.  

 

Monitoring

TMN has the right, but not the obligation, to monitor, screen, block, post, remove, modify, store, and review such content or communications sent through this website at any time and for any reason, including to ensure that the user-generated content or communications conform to this Agreement and any other operating rules established by TMN without prior notice to the User.  

 

Policy Changes

We may add, delete, or modify any of our Services at any time in our sole discretion. We may similarly change this Agreement at any time, and we will notify you of any changes by posting the changes on the Site. Changes will take effect once we notify you ("effective date"). You can always obtain a current copy of this Agreement at any time on our Site. If any change is not acceptable to you, you must stop using the Services. Your use of the Services after the effective date shall constitute your acceptance of such changes. If any new products or services become available, they will be considered a part of the Services and your use of them will be governed by the terms and conditions of this Agreement unless we notify you that different terms and conditions apply. You must also comply with any additional terms which apply to third-party content, material, information, software, or other services.

 

Feedback

TMN welcomes your feedback and suggestions about TMN's products or services or with respect to how to improve the TMN website.  By transmitting any suggestions, information, material, or other content (collectively, “feedback”) to TMN through the TMN website, you represent and warrant that such feedback does not infringe or violate the intellectual property or proprietary rights of any third party and that you have all rights necessary to convey to TMN and enable TMN to use such feedback.  In addition, any feedback received through the TMN website will be deemed to include a royalty-free, perpetual, irrevocable, transferable, non-exclusive right, and license for TMN to adopt, publish, reproduce, disseminate, transmit, distribute, copy, use, create derivative works, and display (in whole or in part) worldwide, or act on such feedback without additional approval or consideration, in any form, media, or technology now known or later developed for the full term of any rights that may exist in such content, and you hereby waive any claim to the contrary.
